Dear ATV Club,

Let me introduce myself. My name is Mike Jennings and I’m a retired Vermont State Police officer. I’m writing you to let you know of a new service that I provide that may help the sometimes-strained relationships that occur between landowners and ATV users. Please let me explain.

Over my 30 years in law enforcement I saw many problems of which there seemed no viable solution. Over the last ten years especially I’ve watched as ATV use has risen throughout the state and so did the problems. There are several main complaints about ATV’s; “The ATV’s are speeding on the roads” and “The ATV’s are damaging my property”. The real problem with ATV complaints is that rarely can the violators be caught. The bottom line is that law enforcement doesn’t have the time or the resources to watch an area long enough to catch the troublemakers. This lack of enforcement often emboldens the violators, infuriates the landowners and as a result, creates a real publicity problem for the law-bidding ATV owners that simply want a place to ride. These publicity problems lead to landowners shutting off their land and stop others from considering allowing ATV access.

I want you to know that as part of my private detective agency I’m offering electronic and/or personal surveillance of problem areas. I’m not talking about surveillance of public roads; I’m talking about surveillance of rural private property that the police will never get to. What this means is that chances are that I can catch the violators and probably identify them for the landowner and since I’m not the police (any more), I can identify the violators and then let the landowner decide to what degree they wish to pursue the problem. The solution could be as simple as a warning to the violator or if the landowner desires I would provide a sworn statement to the police upon which a ticket can be issued.

What I’m really offering is a potential solution to the frustrations that landowners feel (potential because no one can guarantee a 100% successful outcome) and I’m giving your club the ability to refer an irate landowner to me instead of just taking the heat. I would then work with the landowner to identify the violators and solve the problem.

I believe my service could be an asset to an ATV club. You, as a club, rarely have time to catch the violators and yet to do nothing is to risk the loss of a valuable trail or a trail supporting landowner.

I will also be notifying law enforcement of my service hoping that they will refer the landowners to me and I hope you will also.

In closing I do want to state that I am in business and there is a charge for my service but I assure you I will be reasonable and I will offer a real option for some landowners.

It’s already a problem finding places to ride and many landowners are only one complaint away from shutting off access to their property. In partnership with VASA we can stop the violations and show that ATV owners and ATV clubs are interested in protecting the use of private lands.
